Buyer / Traveler

The individual who completes a booking through the website and whose information is provided during the reservation process.

By completing a reservation, making a payment, or using any service offered through the website, the Buyer acknowledges that they have read, understood, and accepted all terms of this Agreement.

1. SUBJECT OF THE AGREEMENT

This Agreement governs the rights and obligations of the Seller and the Buyer regarding the purchase of tours, excursions, transportation services, travel-related activities, and other tourism services offered through the website operated by the Seller.

The details of the purchased service, including price, travel date, destination, number of participants, inclusions, and any applicable conditions, are specified during the booking process and form an integral part of this Agreement.

2. SERVICE INFORMATION

The Buyer acknowledges that all information regarding the purchased service, including itinerary, duration, inclusions, exclusions, pricing, cancellation policies, and special conditions, has been provided before the completion of the reservation.

Photographs, descriptions, maps, and promotional materials displayed on the website are intended for informational purposes and may differ slightly from the actual experience due to operational circumstances.

3. RESERVATION AND PAYMENT

A reservation becomes binding once payment is successfully completed and a booking confirmation is issued by the Seller.

The Seller reserves the right to refuse, suspend, or cancel any reservation if:

• Payment authorization cannot be obtained;
• Incorrect or misleading information is provided by the Buyer;
• The requested service becomes unavailable;
• Operational or safety reasons require cancellation.

All prices displayed on the website are stated in the currency indicated during the booking process and include applicable taxes unless otherwise stated.

4. BUYER'S RESPONSIBILITIES

The Buyer agrees to:

• Provide accurate and complete personal information;
• Arrive at designated meeting points on time;
• Carry all required travel documents, including passports, visas, permits, and identification documents;
• Comply with local laws and regulations;
• Follow instructions provided by guides, drivers, tour leaders, and authorized representatives.

The Seller shall not be responsible for denied participation resulting from incomplete documentation, late arrival, failure to comply with local regulations, or inaccurate information supplied by the Buyer.

5. CHANGES TO BOOKINGS

Requests for modifications are subject to availability and operational feasibility.

The Seller may, when necessary, make reasonable changes to itineraries, schedules, transportation arrangements, or service providers due to weather conditions, force majeure events, governmental restrictions, safety concerns, traffic conditions, port regulations, or operational requirements.

Where a significant change is required, the Seller will make reasonable efforts to notify the Buyer in advance.

6. CANCELLATION AND REFUND POLICY

Cancellation requests must be submitted in writing via email.

Unless otherwise specified in the service description, the following cancellation terms shall apply:

• More than 14 days before the service date: Full refund, less any non-refundable third-party fees.
• Between 7 and 14 days before the service date: 50% refund.
• Less than 7 days before the service date: No refund.
• No-show or late arrival: No refund.

Certain services, including entrance tickets, ferry tickets, flight tickets, private tours, customized arrangements, or services purchased from third-party suppliers, may be non-refundable regardless of the cancellation date. Such conditions will be disclosed during booking where applicable.

Approved refunds shall be processed using the original payment method within the period required by applicable banking and payment systems.

7. RIGHT OF WITHDRAWAL

Pursuant to Article 15 of the Turkish Regulation on Distance Contracts and applicable consumer legislation, the right of withdrawal does not apply to accommodation, transportation, vehicle rental, catering, leisure, entertainment, or tourism services that are scheduled to be provided on a specific date or period.

Accordingly, once a reservation for a tour, excursion, transfer, activity, or travel-related service has been confirmed, the Buyer may not exercise a statutory right of withdrawal.

Cancellation and refund requests shall instead be governed by the cancellation provisions stated in this Agreement and the relevant service description.

8. FORCE MAJEURE

The Seller shall not be liable for any failure or delay in performing its obligations due to circumstances beyond its reasonable control, including but not limited to:

• Natural disasters;
• Severe weather conditions;
• Earthquakes;
• Floods;
• Fires;
• Epidemics or pandemics;
• Government actions or restrictions;
• Port closures;
• Transportation disruptions;
• Strikes;
• Security threats;
• Civil unrest;
• Acts of terrorism.

In such circumstances, the Seller may modify, postpone, suspend, or cancel services without liability beyond any refund rights required by applicable law.

9. LIMITATION OF LIABILITY

The Seller acts as an intermediary and organizer of tourism services and may engage independent suppliers, including transportation companies, guides, museums, attractions, ferry operators, and other service providers.

The Seller shall not be liable for:

• Personal injury resulting from the Buyer's negligence;
• Loss, theft, or damage of personal belongings;
• Delays caused by transportation providers;
• Missed connections;
• Governmental actions;
• Decisions made by immigration, customs, port, or border authorities;
• Events beyond the Seller's reasonable control.

To the maximum extent permitted by law, the Seller's total liability shall not exceed the amount paid by the Buyer for the relevant service.

10. HEALTH AND FITNESS

The Buyer acknowledges that participation in certain tours and activities may involve physical exertion.

The Buyer is responsible for assessing their own physical condition and suitability for participation. Any medical condition, mobility limitation, allergy, or special requirement should be communicated to the Seller before booking.

11. DATA PROTECTION

Personal information collected during the booking process shall be processed solely for reservation management, customer service, legal compliance, and operational purposes.

The Seller shall take reasonable measures to protect personal data in accordance with applicable data protection laws.

12. GOVERNING LAW AND JURISDICTION

This Agreement shall be governed by the laws of the Republic of Türkiye.

Any dispute arising out of or relating to this Agreement shall be subject to the jurisdiction of the Consumer Arbitration Committees and Consumer Courts having authority under Turkish consumer legislation.

13. ACCEPTANCE

The Buyer acknowledges that they have read and understood this Agreement and agree to be legally bound by its provisions by completing a reservation and/or making payment through the website.
